Terms & Conditions

The legal terms that apply when you buy from NM-Watches.

1. Who we are

NM-Watches sources, inspects, and sells pre-owned and vintage watches from Assen, the Netherlands. Throughout these terms, "we," "us," and "NM-Watches" refer to NM-Watches; "you" and "the customer" refer to anyone placing an order or otherwise using our website.

2. Definitions

Agreement means the contract formed between you and NM-Watches when an order is placed and accepted.

Consumer means a private individual buying a watch or accessory for personal use, not in the course of a trade or business.

Product means any watch or accessory offered for sale on our website.

Website means nm-watches.com and any pages or checkout flow hosted on it.

3. Applicability

These terms apply to every order placed through our website. By placing an order, you agree to be bound by them. If we ever publish updated terms, the version in effect at the time you placed your order is the one that applies to that order.

4. Listings and offers

Every watch is inspected in hand and described as accurately as we can before it's listed. Photos are of the actual watch you'd receive, not stock images or manufacturer photography.

Obvious errors in a listing, a wrong price, a mistyped reference number, a mismatched photo, don't bind us to honour them. If we catch a mistake before your order is confirmed, we'll let you know and give you the option to proceed at the correct price or cancel.

A watch shown as available may occasionally already be under offer to another buyer at the moment you order; if that happens, we'll tell you immediately and refund you in full.

5. Placing an order

An order is placed when you complete checkout and payment on our website. We'll send you an email confirming we've received it. The agreement between us becomes final once we confirm your order has been accepted, not at the moment you submit payment, this gives us a short window to catch stock or pricing errors before committing either of us to the sale.

We reserve the right to decline or cancel an order, for example if the watch turns out to be unavailable, if we suspect fraud, or if your billing or shipping details can't be verified. If we cancel an order, you'll be refunded in full and notified by email.

6. Prices and payment

All prices on our website are listed in euros and include VAT where applicable under Dutch and EU law. We reserve the right to change listed prices at any time; the price that applies to your order is the one shown at the moment you complete checkout.

Payment is processed through a secure third-party payment provider. We never see or store your full card or bank details ourselves. Full payment is required before an order is dispatched.

Shipping costs, and any import duties or taxes due on delivery for orders outside the EU, are the customer's responsibility unless stated otherwise at checkout.

7. Your right of withdrawal

If you're an EU consumer, you have the right to withdraw from your purchase within 14 calendar days of receiving it, without giving a reason, under the EU Consumer Rights Directive. Full details of how this works in practice, including how to start a return and how refunds are handled, are set out in our Shipping & Returns policy, which forms part of these terms.

8. Delivery

We aim to dispatch every order within a few business days of payment being confirmed. Delivery estimates given on our website or by email are our best estimate, not a guarantee, we're not liable for delays caused by the courier once a watch has left us, though we will always help you chase a shipment that's running late.

Risk in the watch passes to you once it's delivered to the address you provided at checkout. Until that point, we carry the risk, which is why every shipment is fully insured.

9. Warranty

Every watch we sell has passed our own inspection for authenticity, condition, and function before being listed. Beyond your statutory rights as a consumer, we stand behind the mechanical condition of every watch at the time of sale, if something we should have caught during inspection turns out to be wrong, contact us and we'll make it right.

Normal wear from use after delivery, and damage caused by accident, water exposure beyond a watch's rated resistance, or unauthorised repair, isn't covered.

10. Liability

Nothing in these terms limits any liability that can't legally be limited, such as liability for fraud or for death or personal injury caused by our negligence. Beyond that, our liability to you in connection with an order is limited to the amount you paid for that order.

11. Intellectual property

All text, photography, and design on our website belongs to NM-Watches or is used with permission. You're welcome to share a listing or photo with a link back to us; please don't reproduce our photography or descriptions elsewhere without asking first.

12. Governing law and disputes

These terms are governed by the law of the Netherlands. If a dispute ever arises, we'd genuinely rather resolve it directly with you than through any formal process, email us first and we'll do what we can to sort it out. Where a dispute can't be resolved directly, it will be submitted to the competent court in the Netherlands, without prejudice to any mandatory consumer protection rules that entitle you to bring a claim in your own country of residence.

13. Changes to these terms

We may update these terms from time to time, for example to reflect a change in how we operate or in the law. Changes apply to orders placed after the updated terms are published; they don't change the terms that applied to an order you've already placed.
